Privacy Notice – MyLocalJobs

This Privacy Notice describes how Metcash Services Company Pty Ltd (ABN 85 691 110 399) and its related bodies corporate (collectively, Metcash, we, our or us) handle personal information collected as part of the MyLocalJobs platform at https://mylocaljobs.com.au/ and related services (Platform).

This Privacy Notice should be read in conjunction with applicable privacy policies, such as the Metcash Group General Privacy Policy, and any other privacy notices that are referenced or shown to you when personal information is collected about you for specific purposes.

Please note that the handling of personal information by third parties as contemplated in this Privacy Notice (such as Employers, as defined below) will generally be subject to the privacy policies of those third parties.

This Privacy Notice describes the handling of personal information of individuals who use the Platform to search and apply for job opportunities (Job Seekers), and individuals that use the Platform to advertise job opportunities and recruit Job Seekers (Employers).

This Privacy Notice applies to all users of the Platform, including Job Seekers and Employers, regardless of whether you have created an account.

1. What personal information we collect and how we collect

(i) Collection from you

We collect your personal information from you in various circumstances such as those outlined below.

Your name, contact details, month and year of birth, photograph (optional), location (including your home suburb or postcode), employment history and work experience, skills and credentials, rights to work-related information (e.g. visa status and conditions, citizenship details, residency or immigration status, and work eligibility details), work availability, pay expectations, video and/or audio recordings (optional), job application details, details of your interactions with the Platform and any other information about you that you provide while on the Platform.

When you register for the Program, we may link your profile to information we hold about you, such as information relating to your accounts with Metcash and information collected based on your IP address or other technical identifier. For more information about our use of cookies and other similar technologies, please see section 3(b)(ii) (“Digital technologies”) of the Metcash Group - General Privacy Policy. Examples of the kinds of information we collect using such technologies when you interact with us online are set out below.

Information we collect about you in the future will also be linked to your profile.

Employers – when you register for an account, create a profile or post an advertisement

Business name and logo, business address and billing address, business details, ABN, primary contact name, contact details, month and year of birth, job advertisement details, details of your interactions with the Platform and any other information about you that you provide while on the Platform (noting that information relating to your business may be personal information in certain circumstances).

When you register for the Program, we may link your profile to information we hold about you, such as information relating to your accounts with Metcash and information collected based on your IP address or other technical identifier. For more information about our use of cookies and other similar technologies, please see section 3(b)(ii) (“Digital technologies”) of the Metcash Group - General Privacy Policy. Examples of the kinds of information we collect using such technologies when you interact with us online are set out below.

Information we collect about you in the future will also be linked to your profile.

When you use your MyLocalJobs account to interact with us (e.g. logging-in to your account to use our Platform)Your user content, preferences, user activity, information regarding your access to and use of the Platform (including IP address, browser, device and operating system identifier and other technical identifiers, information input, referring domain, links and content accessed, device type, operating system, browser type, location and browsing habits) which may be collected via certain digital technologies as described in section 3(b)(ii) (“Digital technologies”) of the Metcash Group General Privacy Policy.
When you communicate with us or with other users via the direct messaging functionality on the PlatformYour name and details of the communications that you are involved in.
When you submit a query, make a complaint or report, or provide feedbackYour name, contact details, details regarding your query, complaint or report, or feedback and any responses provided.

We may also collect sensitive information about you if you choose to provide such information through the Platform.

If you do not provide requested personal information:

  • you may not be able to register for, or use, the Platform;
  • you may not be able to access certain features or functionality of the Platform (such as creating a profile or “Work Passport”, posting a job advertisement or submitting an application);
  • we may not be able to adequately address your query or concerns (including taking appropriate action in relation to any complaint or report); or
  • we may not be able to personalise your experience or deliver marketing communications that are relevant to you.

Where you provide us with personal information of other individuals (such as referees), you must ensure that they are aware of the terms of this Privacy Notice.

(ii) Collection from parties other than you

We may collect your personal information from third parties in certain circumstances, including when:

  • we conduct relevant checks (e.g. we may collect personal information about you from government sources when verifying your credentials against government databases); and
  • we use or conduct data analytics. For example, we may collect your personal information from related companies and members of the Metcash group, third parties (such as Metcash Services vendors, digital platforms, data brokers and other service providers) or other sources of publicly available information. We may match or combine that information with information we hold about you for the purposes described below in section 2 (“Generating insights and business improvements”).

We also collect personal information about you when we (or our service providers) generate insights and inferences about you using data analytics or technologies such as AI.

We may also collect personal information about you from the other parties described below in section 3 (“Who we disclose your personal information to”).

2. Why we collect, hold, use and disclose your personal information

We collect, hold, use and disclose your personal information to manage our business, including for the following purposes:

  • assisting and enabling Job Seekers in searching and applying for job opportunities;
  • assisting and enabling Employers in advertising job opportunities and recruiting Job Seekers;
  • making your profile searchable and viewable;
  • providing the functionality of the Platform;
  • conducting relevant checks (e.g. verifications of credentials);
  • responding to queries, complaints or reports, and feedback; and
  • managing claims.
Communicating and promoting products, services and other benefits
  • sending communications about the Platform and associated accounts;
  • personalising your experience while you are on our platforms (such as websites and apps); and
  • sending or displaying Metcash and third party offers and promotions (including marketing communications (e.g. email or SMS) and advertising on our platforms and third party websites and apps such as social media platforms).

For certain types of marketing communications (e.g. email or SMS), the ability to unsubscribe is included in the marketing communications themselves. For other types of direct marketing, including online advertising where this involves the use or disclosure of your personal information, you can opt-out by emailing privacy@metcash.com.

Generating insights and business improvements
  • using or conducting data analytics (including about preferences and trends); and/or
  • matching or combining personal information we hold with other information we hold about you or information held by related companies and Metcash group members or from third parties (such as Metcash Services vendors, digital platforms, data brokers and other service providers) or publicly accessible sources,

to generate insights that help:

  • better understand Metcash customer needs, preferences and experiences;
  • identify customers with similar characteristics to another group of customers;
  • develop and enhance marketing, products and services, platforms and systems of both Metcash and third parties.

Protecting people, assets (including data) and our business
  • managing and preventing theft, fraud, misconduct, criminal activity and breaches of our Terms of Use or Community Standards;
  • protecting information that we hold;
  • managing complaints and reports, including those relating to user safety;
  • managing the safety and security of the Platform and users of the Platform; and
  • preventing access to relevant parts of our Platform (e.g. due to security reasons or age-based restrictions).
Complying with laws and regulations and other applicable requirements, and obtaining advice
  • verifying your age and credentials (where applicable);
  • complying with court orders or subpoenas; and
  • complying with our online safety obligations, including laws and regulations regarding prohibited material and user safety;
  • obtaining professional advice (e.g. legal, accounting, auditing or consulting advice).
Managing administrative matters
  • managing retention and storage of data (including with third party service providers); and
  • supporting corporate transactions (e.g. mergers and acquisitions) which, for example, may include disclosure to proposed or actual purchasers of our business or assets.

We may also de-identify and/or aggregate personal information, and use and disclose the de-identified and/or aggregated data for any purpose.

In addition, we collect, hold, use and disclose your personal information for other purposes permitted by law, as outlined in the Metcash Group General Privacy Policy or as disclosed to you from time to time.

3. Who we disclose your personal information to

We disclose your personal information to third parties including:

  • related companies and members of the Metcash group;
  • agents;
  • service providers and business partners (e.g. providers of technology, business support, data, analytics and marketing services);
  • digital platforms with whom we engage or advertise or use to create advertising segments or audiences or generate other insights;
  • other users of the Platform (e.g. when you create a profile or “Work Passport”, when you post a job advertisement as an Employer or when you submit a job application as a Job Seeker);
  • parties assisting with conducting relevant checks (e.g. verifying credentials against government databases);
  • payment processing providers, financial institutions and payment schemes;
  • professional advisors (e.g. legal, accounting, auditing or consulting advisors);
  • regulatory authorities, enforcement bodies and government agencies;
  • parties to relevant corporate transactions (including investors and purchasers of all or parts of our business or assets, whether prospective or otherwise); and
  • other third parties where relevant for purposes described above in section 2 (“Why we collect, hold, use and disclose your personal information”).

We also disclose your personal information when permitted or required by law.

Some of the third parties that your personal information is disclosed to are located overseas.

4. Automated decisions

We, and our service providers, may use computer programs to filter out individuals who do not meet certain eligibility requirements on our Platform.

For example, these programs may use your month and year of birth (as provided during account registration or subsequently updated in your profile) to filter out:

  • individuals who do not meet the minimum age requirement of 15 years of age for Job Seekers or 18 years of age for Employers, for setting up an account on the Platform;
  • individuals who do not meet the minimum age requirement of 18 years of age, for accessing certain Platform features or functionality; and/or
  • individuals who do not meet the minimum age requirement for a job advertised on the Platform (e.g. 18 years of age or older for jobs that require an RSA certificate).
